Welcome to BubsNest ("we", "our", "us", or the "Platform"). These Terms of Service ("Terms") govern your use of our website at bubsnest.co and related services.

By creating an account or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

We are a company registered in England and Wales. These Terms are governed by English law.

BubsNest provides:

• Registry Creation: Tools for parents to create and manage baby shower gift registries
• Product Linking: Ability to add items from UK retailers by pasting product URLs
• Sharing Features: Tools to share your registry with friends and family
• Purchase Tracking: An honour-based system for gift-givers to mark items as purchased
• Group Gifts: Ability to collect contributions towards expensive items
• Cash Funds: Option to receive monetary contributions

We operate on an affiliate model, earning commission when purchases are made through our links. We do not sell products directly or hold inventory. We aggregate publicly available product information from UK retailer websites to help you compare prices and find items across multiple stores. This information is provided for convenience only.

3.1 Eligibility

To create an account, you must be at least 18 years old and have the legal capacity to enter into these Terms. By registering, you represent that you meet these requirements.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised access

3.3 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

4.1 Registry Content

When creating a registry, you agree to:

• Only add items you genuinely want for your baby
• Provide accurate information about your baby and due date
• Not use the platform for fraudulent purposes
• Not add inappropriate, offensive, or illegal content

4.2 Product Information and Accuracy

Product details (names, prices, images, descriptions) are fetched from retailer websites using automated systems at the time of addition. We do not guarantee the accuracy, completeness, or currency of this information. Prices, availability, and product details may change on retailer websites at any time. The information displayed on BubsNest is a snapshot and may not reflect the current state of the product on the retailer's website.

We periodically check retailer websites to update product prices, but these checks are not real-time. Prices displayed on BubsNest may be outdated by hours or days. Always verify the current price on the retailer's website before purchasing.

4.3 Product Matching and Variants

BubsNest uses automated technology to identify and match products across different retailers. This matching is performed on a best-effort basis and may not always be exact. In particular:

• Products may be available in multiple colours, sizes, configurations, or bundles (collectively, "variants"). Our automated systems may match a product to a retailer listing that features a different variant (e.g., a different colour or size) than the one originally added to the registry.
• Product images displayed on BubsNest may not correspond exactly to the variant available at the linked retailer.
• Retailers may update, discontinue, or modify product listings at any time without notice to us.

It is the responsibility of the gift-giver to verify the exact product, variant, colour, size, and specification on the retailer's website before completing any purchase. BubsNest is not responsible for purchases of incorrect variants or products that do not match the registry owner's expectations.

4.4 Purchase Tracking

Our purchase tracking system operates on an honour basis. Gift-givers self-report when they have purchased items. We cannot verify actual purchases and are not responsible for duplicate gifts or items marked incorrectly.

4.5 Automated and AI-Powered Features

Certain features of BubsNest use artificial intelligence and automated technology, including product categorisation, product matching across retailers, and product information extraction. These features operate automatically and may produce inaccurate or incomplete results. AI-generated outputs are provided as a convenience and should not be relied upon as the sole basis for any purchasing or other decision.

5.1 Free Services

Creating and managing a registry is free. There are no subscription fees or platform charges for using BubsNest.

5.2 Payment Processing Fees

BubsNest is completely free for registry owners. We charge gift-givers a small fee of 2% + 30p on group gift and cash fund contributions to keep the platform running. This fee is shown clearly before payment is confirmed.

For funds transferred to registry owners, Stripe charges a minimal processing fee (1.5% + 20p for UK cards) which goes directly to them. International cards may incur additional fees as per Stripe's pricing.

5.3 Stripe Connect

To receive group gift and cash fund contributions, you must connect a Stripe account. By doing so, you also agree to Stripe's Connected Account Agreement.

Group gift and cash fund contributions are processed as direct charges to the registry owner's connected Stripe account. You must connect a Stripe account before you can receive contributions. BubsNest does not hold, manage, or have access to contributed funds at any point. All fund management, payouts, and disputes are handled directly by Stripe in accordance with their terms.

5.4 Refunds

Contributions to group gifts and cash funds are generally non-refundable. If a contributor requests a refund, we will review on a case-by-case basis. Refunds may be subject to processing fees.

5.5 Currency

All prices and contributions are in British Pounds Sterling (GBP).

5.6 Email Communications

By creating an account, you consent to receive transactional emails related to your registry, including gift notifications, contribution alerts, and account updates. These are service-related communications necessary for the operation of your registry. You may unsubscribe from non-essential notifications at any time via the unsubscribe link in each email or through your account settings.

When you click to purchase an item from a registry, you will be redirected to the retailer's website through an affiliate link. We may earn a commission on qualifying purchases.

We are not responsible for:

• The availability, pricing, or quality of products on retailer websites
• Transactions between you and retailers
• Retailer policies on returns, refunds, or customer service
• Changes to product listings after items are added to a registry
• Differences in product variants (colour, size, configuration) between what is shown on BubsNest and what is available at the retailer
• Purchases of incorrect products or variants made through our links

Any purchases you make are subject to the retailer's terms and conditions.

You agree not to:

• Use the platform for any unlawful purpose
• Create fake registries or impersonate others
• Attempt to collect contributions fraudulently
• Harass, abuse, or harm other users
• Upload malicious code or attempt to compromise our systems
• Scrape, copy, or reproduce our content without permission
• Use automated systems to access the platform without our consent
• Interfere with the proper functioning of the platform

We reserve the right to suspend or terminate accounts that violate these Terms.

8.1 Our Content

The platform, including its design, features, and content (excluding user content and third-party product information), is owned by us and protected by copyright and other intellectual property laws.

8.2 Your Content

You retain ownership of content you create (such as welcome messages). By posting content, you grant us a licence to display it as part of your registry and our services.

8.3 Third-Party Content

Product images, descriptions, and other content from retailers remain the property of their respective owners. Product images displayed on BubsNest are sourced from retailer websites and are used solely to help identify products on your registry. We do not claim ownership of these images. If you are a rights holder and wish to request removal of content, please contact us.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy or completeness of product information
• Correctness of automated product matching across retailers
• Accuracy of product variant information (colours, sizes, configurations)
• Uninterrupted or error-free service
• Security of data transmission

We do not guarantee that gift-givers will purchase items from your registry or that contributions will reach any particular amount.

Our automated product matching and price comparison features use technology that may produce inaccurate results. These features are provided as a convenience only and should not be relied upon as the sole basis for purchasing decisions. Users should always verify product details directly on the retailer's website.

To the maximum extent permitted by law, we shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Damages arising from your use of or inability to use our services
• Actions of third parties, including retailers and gift-givers
• Purchases of incorrect products, variants, colours, or sizes resulting from our automated product matching
• Inaccuracies in product information, pricing, or images displayed on our platform
• Any costs associated with returning or exchanging products purchased through retailer links on our platform

Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount of platform fees you have paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Content you post on the platform

12.1 By You

You may delete your account at any time through your account settings. Upon deletion, your registry and personal data will be removed. However, we may retain certain records as required or permitted by applicable law, including financial transaction records and anonymised usage data. Data shared with third-party payment processors (Stripe) is subject to their own retention policies.

12.2 By Us

We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion. We will provide notice where reasonably possible.

12.3 Effect of Termination

Upon termination, your right to use our services ceases immediately. Provisions that should survive termination (such as limitation of liability) will remain in effect.

We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of our services after changes take effect constitutes acceptance of the modified Terms.

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have rights under the laws of your country of residence.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect
• Waiver: Our failure to enforce any right does not waive that right
• Assignment: You may not assign your rights under these Terms without our consent
